Controlling Scheduled Carcinogenic Substances at Work

Scheduled carcinogenic substances must be identified and assessed before they are used. The first question is whether the substance or process can be eliminated or replaced with something safer. If use continues, exposure must be prevented or tightly controlled using measures suited to the actual task.

Additional requirements may apply to purchasing, permitted use, notification, monitoring and records. Confirm them with the relevant WHS or OHS regulator before bringing the substance onto site.

What is a scheduled carcinogenic substance?

A carcinogenic substance can cause or contribute to cancer. A scheduled carcinogenic substance is one placed on a regulatory schedule and made subject to specific controls.

Not every chemical classified as carcinogenic is necessarily a scheduled carcinogenic substance. Familiar construction hazards such as asbestos and respirable crystalline silica also have their own detailed requirements. Check the current safety data sheet, supplier information and regulator material rather than relying on a product name or general description.

Important exposure routes and hazards include:

  • breathing dust, mist, fumes or vapour
  • skin contact or absorption
  • accidental ingestion from contaminated hands, food or surfaces
  • contamination of clothing, tools, vehicles and shared areas
  • exposure during spills, cleaning, maintenance or waste handling
  • delayed health effects that may not be immediately apparent.

What should be sorted before work starts?

Confirm the substance or mixture, its concentration, the quantity required and whether it is scheduled in the relevant jurisdiction. Obtain a current safety data sheet and examine the proposed task, equipment, work area and likely exposure routes.

The assessment should reflect the actual work. Consider operators, nearby trades, cleaners, maintenance workers, visitors and people handling contaminated waste. The national code says a generic assessment is not sufficient for work involving potential exposure to a scheduled carcinogenic substance.

Before use, establish:

  • whether the substance or process can be eliminated or replaced
  • whether notification, acknowledgement, exemption or conditions apply
  • how the substance will be contained and exposure controlled
  • how access, hygiene and contamination will be managed
  • whether workplace monitoring is needed and how often
  • who will advise on any appropriate occupational health arrangements
  • how spills, emergencies, decontamination and waste will be managed
  • what information, training and supervision workers need.

Consult affected workers and coordinate the controls with the principal contractor and other businesses sharing the workplace.

What do good controls look like?

Start with elimination. If that is not practicable, consider a non-carcinogenic alternative, a substance that is not scheduled, a safer physical form or a process that creates less exposure.

Where use continues, the code says exposure should be prevented or adequately controlled. The control combination should match the task and may include:

  • a closed or remotely operated process
  • isolation and restricted work areas
  • local exhaust ventilation or capture at the source
  • equipment and work methods that minimise dust, fumes or vapour
  • regular cleaning and controlled decontamination
  • warning signs and access limited to trained, authorised workers
  • suitable personal protective equipment as an additional layer.

Inspect, test and maintain critical controls. A damaged enclosure, poorly positioned extractor or incorrectly used respirator can leave workers exposed.

What documents and records are commonly needed?

The document set should match the substance, task and jurisdiction. It commonly includes a current safety data sheet, substance register, task-specific risk assessment, safe work procedure, regulator correspondence and any applicable conditions.

Other records may cover monitoring, training, consultation, emergency arrangements, potential exposure, maintenance, faults, corrective actions and waste disposal. Documents should identify responsibilities, restricted areas, required controls and actions following a spill or suspected exposure.

When does a SWMS apply?

A safe work method statement commonly applies when the task is high risk construction work under the rules of the relevant jurisdiction or when the principal contractor or project requires one.

The SWMS should address the high risk construction activity and its site interfaces. The chemical may also need a separate task-specific risk assessment, safety data sheet, safe work procedure, regulator notification or exposure-control plan. Where the task is not high risk construction work, a site-specific risk assessment and procedure may be more appropriate.

Practical warning signs

Stop and review the work if:

  • the safety data sheet is missing, outdated or does not match the product
  • the substance's scheduled status has not been checked
  • workers rely only on gloves or respirators
  • dust, fumes or contamination can escape the controlled area
  • extraction or containment has not been tested
  • workers cannot explain decontamination or emergency steps
  • regulator correspondence, exposure records or training evidence cannot be found
  • the substance, quantity, process or work area changes without reassessment.
