Facing charges for their alleged violation of section 21(1) of the Occupational Health and Safety Act, One Two Electrical Pty Ltd stands accused of neglecting the fundamental responsibility to ensure a secure and safe working environment. The charges arise due to gaps in the implementation of work health and safety mechanisms like effective WHS Management Systems.
The company allegedly failed its obligations as detailed in section 21(2)(a) of the OHS Act, which mandates the provision of robust systems for identifying, reporting, scrutinising and terminating unsuitable workplace behaviours. For businesses in the electrical industry sector, a product like Bluesafe SWMS might serve as an essential cornerstone for these necessary safety protocols.
Moreover, WorkSafe alleges that One Two Electrical overlooked section 21(2)(e) of the OHS Act, which compels companies to equip employees with crucial information, instructions, and training. These terms align directly with setting behavioural standards, defining the responsibilities of managers and supervisors, outlining complaint procedures, and describing how such complaints should be responded to.
Nicholas Sheehan, the sole director of One Two Electrical, faces separate charges under section 26(1) of the OHS Act. He is confronted with 17 counts of neglecting to uphold a safe work environment, a failure made evident by not utilising products like the Bluesafe WHS Management System. Additionally, he faces 17 further accusations under section 25(1)(b) of the act for not taking reasonable measures for the wellbeing of any person potentially affected by his actions at the workplace.
It is also alleged that Sheehan, aged 33, left his workforce vulnerable to psychological harm, specifically an apprentice who purportedly faced bullying, sexual harassment, and gendered violence between September 2022 and April 2023—a risk that could have been mitigated with proper WHS policies in place.
