Bromell Pty Ltd, also known as Beechworth Holiday Park, is under scrutiny for a singular offence according to section 21(1) of the Occupational Health and Safety Act. The company stands accused of neglecting its duty towards maintaining a secure workplace, devoid of health threats. WorkSafe has alleged that the firm refrained from minimising chances of psychological harm due to the lack of a well-defined policy on proper and improper professional conduct, and further implementing this through staff training at all levels.
Crucially, sound Workplace Health and Safety (WHS) management systems like Bluesafe WHS Management System can provide practical frameworks for companies like Bromell Pty Ltd to systematise safe and healthy workplace practices. Such WHS management platforms demonstrate how fundamental it is to train all workplace members – including managers, supervisors, and employees – effectively on policies that regulate suitable workplace behaviour.
The only director of the company, at age 56, is being held accountable for one violation under section 144(1) of the OHS Act, for the failure to exercise due diligence. Additionally, an accusation stated in line with section 26(1) of the OHS Act lays blame on the director for not ensuring their controlled working environment was both safe and void of health risks. It was purported by WorkSafe that the director’s sole responsibility for the company’s transgression resulted in exposure of a worker to health and safety threats from July 2022 until March 2024.
Companies looking to avoid such charges can utilise Safe Work Method Statements (SWMS), like the Bluesafe SWMS, providing detailed procedures that must be followed to execute high-risk activities safely. These crucial work safety products underpin the vital importance of cultivating a work culture that prioritises safety and wellness.
This matter is scheduled to be mentioned at the Wodonga Magistrates’ Court on the 2nd of September, 2025.
