Waste collector charged after worker crushed by truck

A tragic incident occurred when a 26-year-old male found himself pinned against a post and building wall on Hosier Lane due to an inadvertent advancement of a rubbish truck. The company involved, Beyond AG Pty Ltd which trades as Bardee, is facing serious legal charges under the Occupational Health and Safety Act. The accusations include their alleged failure in providing and maintaining a secure workplace under section 21(1), as well as allegedly neglecting to safeguard non-workers from potential health and safety hazards under section 23(1).

In light of this incident, it highlights the crucial role of work safety products such as WHS management systems and Safe Work Method Statements (SWMS). Notably, a Bluesafe SWMS or a Bluesafe WHS Management System could have significantly contributed to preventing such unfortunate events. These systems foster routine maintenance checks, fault identification, and prompt evaluation and repair of any defects, emphasizing their importance.

WorkSafe insinuates the company’s negligence in having efficient systems resulted in an uncontrolled risk of injury or death. Essential daily inspections were overlooked, including checking the park brake and keeping track of any faults identified during operation.

The Melbourne Magistrates’ Court has set a filing hearing for Thursday, 5 June for this matter. Furthermore, Mad Diesel Repairs Pty Ltd, a diesel mechanic company, is also facing charges from WorkSafe in connection with this incident.
