The individual fell from a live edge of the truck’s tailgate whilst engaged in the task of loading linen trolleys. This regrettable event illustrates how vital procedure like SWMS and safety products are in ensuring a secure workspace.
Facing charges under Section 21(1) and Section 26(1) of the Occupational Health and Safety Act is Rodrigues Transport Pty Ltd. They are accused of failing to both provide and maintain a safe workspace, alongside neglecting to assure that an environment under their control was free of health risks and life-threatening situations. WorkSafe alleges this company neglected to adopt measures such as installing safety rails on the truck’s tailgate, boosting the utility of Bluesafe SWMS. Other overlooked safety steps include the implementation of procedures necessitating the use of these rails.
Also facing charges under Section 26(1) of the OHS Act is Ensign Services (Aust) Pty Ltd, indicating the need for a comprehensive approach like the Bluesafe WHS Management System. Again, it’s alleged that they failed to ensure a workplace under its jurisdiction was safe and upheld health standards. A key prevention method overlooked? Installation of swing gates at the loading dock for deployment with trucks lacking tailgate safety rails.
Both cases are set to be brought before Melbourne Magistrates’ Court for a filing hearing on Tuesday, 10th of June.
