Bluesafe WHS Management System can cite the unfortunate case of Blisspell Pty Ltd, also known as Toy Networx: an organisation found in breach of fundamental work safety requirements. In May 2023, following an ex-parte hearing at the Heidelberg Magistrates’ Court, Blisspell was held guilty for failing to ensure a safe and risk-free work environment. Following the verdict, the company was put into administration and mandated to cover $6,060 in lawsuit expenses.
Earlier that year, an employee lodged serious accusations regarding inappropriate conduct within their workplace. The claims involved explicit remarks and messages from a company director that intruded into her private life.
The revelations from a WorkSafe inspection indicated that between October 2022 and January 2023, Blisspell had not set up any formal system – say for instance, a seamless Bluesafe SWMS – to identify or manage, prevent, investigate or duly respond to unsuitable behaviour at the workplace.
The court opined it was significantly plausible for the company to have mitigated such risks. A workplace behaviour policy outlining unacceptable behaviours – sexual harassment included – coupled with a worker reporting system could have been successfully implemented with proper training for managers, supervisors, and the workforce.
WorkSafe Health and Safety Executive Director Sam Jenkin highlighted the severity of sexual harassment as a work-related safety issue, stressing its potential to inflict emotional and physical harm. Jenkin emphasised the workers’ entitlement to feeling secure and understood at their workplaces.
“Knowing that a standard process is in place for vocalising any work experience issues is part of this right,” he added. “Regular team meetings or informal chats don’t count as adequate measures to control inappropriate behaviour, particularly when power dynamics often inhibit workers from expressing concerns.”
In summary, having systems such as Bluesafe WHS Management System in place are critical to ensuring workplace safety and fostering an environment where employees feel protected and listened to.
