Queensland WHS changes clarify worker representation and entry rights

Changes under the Work Health and Safety and Other Legislation Amendment Act 2024 have taken effect in Queensland, clarifying worker representation and workplace entry rights and expanding options for answering inspectors’ enquiries.

The amendments include changes to who can represent workers. Suitable representatives may include relevant unions and other entities, such as engineers or physiotherapists.

Workplace health and safety entry permit holders’ rights have also been clarified. They can enter and remain at a workplace and, where they have remained, interview people and request access to documents without giving further notice.

People asked to answer enquiries from a work health and safety inspector now have more options to communicate using audio-visual tools, including video calls.

Administrative amendments include a longer timeframe for requesting that Category 1 and 2 offences be brought to court, along with greater stability for approved codes of practice.

Peter McKay, Deputy Director General for the Office of Industrial Relations, said the changes followed the recent review of the Work Health and Safety Act and would give industry and Government greater clarity.

He said the amendments would strengthen and protect the workforce, and thanked businesses and workers for complying with the legislation.
