Beyond AG Pty Ltd, trading as Bardee, faces two health and safety charges after a garbage truck rolled forward and crushed a 26-year-old worker in Hosier Lane.

The man was standing near the truck when it moved forward, trapping him against a post and a building wall.

The company faces one charge under section 21(1) of the Occupational Health and Safety Act for allegedly failing to provide and maintain a safe workplace. A second charge, under section 23(1), alleges it failed to ensure people other than workers were not exposed to health and safety risks.

WorkSafe alleges the company failed to reduce the risk of injury or death through a system of work requiring daily truck checks, including checks of the park brake. The alleged failures also concern recording and reporting faults identified during checks or while driving, and ensuring faults were assessed and repaired promptly.

A filing hearing is scheduled at Melbourne Magistrates’ Court for Thursday 5 June.

WorkSafe has also charged diesel mechanic Mad Diesel Repairs Pty Ltd over the incident.
