Two companies face charges following an incident in July 2023 in which a worker was seriously injured while carrying out plumbing work at a warehouse under construction.

The worker was crushed between an overhead pipe and the rail of an elevated work platform. The platform did not have secondary guarding installed.

Cormack's Plumbing Services Pty Ltd faces two charges under section 21(1) of the Occupational Health and Safety Act over an alleged failure to provide and maintain a safe workplace.

WorkSafe alleges the company breached section 21(1)(a) twice by failing to provide and maintain plant and systems of work that were safe and without risks to health, so far as reasonably practicable.

Texco Construction (Vic) Pty Ltd faces one charge under section 26(1) of the Act. The charge concerns an alleged failure to ensure a workplace under its management or control was safe and without risks to health.

Both matters are scheduled for committal mention at the Melbourne Magistrates' Court on 28 February 2025.
