Bell Plaster Supplies Pty Ltd has entered into an enforceable undertaking estimated at $480,509 after a worker suffered a serious foot injury when struck by a reversing forklift.
The Broadmeadows Magistrates' Court heard on Wednesday 27 March that the company had entered into the undertaking while facing one charge of failing to reduce the risk of powered mobile plant colliding with pedestrians.
The incident occurred in April 2022. The worker suffered an open wound fracture to his right foot and needed multiple surgeries.
WorkSafe alleged it was reasonably practicable for the company to have a fully implemented traffic management plan, designated forklift and pedestrian zones, and a temporary exclusion zone around operating forklifts.
The alleged precautions also included using spotters when necessary, installing speed limit signs, and ensuring all forklifts underwent daily inspections and ongoing maintenance.
WorkSafe can reinstate the charge if the undertaking is breached or withdrawn.
WorkSafe Executive Director of Health and Safety Narelle Beer said employers must do everything they can to ensure mobile plant, including forklifts, operates safely. "Forklifts are among the biggest causes of workplace injuries and deaths in Victorian workplaces," Dr Beer said. "Even an incident involving a slow-moving forklift can have serious consequences."
