SafeWork NSW to become standalone regulator after independent review

The NSW Government will make SafeWork NSW a standalone work health and safety regulator following a 12-month inquiry led by former judge The Hon. Robert McDougall KC. The Government has released the independent report and endorsed its recommendations.

Work is underway to determine how the recommendations will be implemented, with detailed options for the standalone regulator’s structure being developed for the Government to consider.

Several recommended reforms began after March last year. These include reviewing SafeWork’s ability to triage incidents, improving contact centre responsiveness and bringing together SafeWork staff who had been spread across the Department of Customer Service.

The independent review drew on public consultation, including submissions from current and former SafeWork staff, families of injured and deceased workers, unions, peak bodies, employer groups and SafeWork itself.

Labor sought the inquiry while in opposition, following concerns about the regulator’s performance under Liberal-National ministers, including its response to the emerging silica threat.

Minister for Work Health and Safety Sophie Cotsis committed to improving processes so family members are kept informed throughout investigations, and to supporting SafeWork inspectors in their work.

“Worker safety is not red tape, it is not a tick a box function, it is not a cost of doing business.” Ms Cotsis said. “It is a fundamental right for every worker to go to their job and come home safely.”

SafeWork NSW’s Trent Curtin said the review’s recommendations would help the organisation become a stronger and more responsive regulator. He said SafeWork would examine its regulatory approaches and support systems, with work already underway.
