NSW seeks feedback on tunnelling safety code to tackle silica risks

The NSW Government has opened consultation on an updated tunnelling safety code aimed at protecting workers from silica dust and other construction hazards. Industry and unions are invited to make submissions until 28 November 2025.

The existing Tunnels Under Construction Code of Practice has not been reviewed since 2006. Consultation on its replacement, the Health and safety risk management of tunnels and shafts in construction code of practice, is being conducted through the Have Your Say website.

Tunnel construction supports public transport infrastructure but exposes workers to hazards, including silica dust released from rock and sandstone. NSW has had 516 cases of silicosis and 36 deaths from the disease since 2017.

SafeWork NSW reported conducting more than 100 inspections at tunnelling sites across the Sydney metropolitan area since January 2024.

The draft code was developed with an industry and social partners working group and addresses a range of tunnel construction activities. The government will review submissions and continue discussions with industry and unions before finalising it.

Minister for Work Health and Safety Sophie Cotsis said the consultation would give people an opportunity to help shape protections for tunnel construction workers. She said worker safety affected not only those on the job but also their families, friends and communities.

Ms Cotsis described the reviewed code as building on government action to address high-crystalline silica processing risks, including the engineered stone ban, the establishment of the Tunnelling Dust Safety Taskforce and the launch of the silica worker register.

SafeWork NSW Commissioner Janet Schorer said: “Addressing the dangers of silica and protecting workers building the infrastructure of our future is a priority for SafeWork NSW and ensuring our codes of practices are updated and reflect best practice is crucial in making that happen.”

Submissions and further information about the draft code are available through Have Your Say. Workers with workplace safety concerns are encouraged to contact SafeWork NSW on 13 10 50.
