Kellogg Australia has been fined $510,000 after a reversing truck struck a scissor lift carrying two workers at a loading dock. Both workers suffered fractures when the lift fell about four metres.
SafeWork NSW successfully prosecuted Kellogg (Aust) over the incident. The company pleaded guilty to an offence under section 32 of the Work Health and Safety Act 2011 (NSW), for failing to meet its duty under section 19(1).
The incident occurred on 3 March 2023. A truck reversing into a loading dock hit a scissor lift with two workers aboard, causing it to fall about four metres to the ground with both workers inside.
One worker sustained fractures to their pelvis and vertebrae. The other suffered a fractured hand. Kellogg (Aust) Pty Ltd has the right to appeal the sentence, and the full judgment is available through NSW Caselaw.
Minister for Work Health and Safety Sophie Cotsis said the Government, employers and unions had an important role in protecting workers. She said establishing SafeWork NSW as a standalone regulator sent a clear message that workplace safety was non-negotiable.
Ms Cotsis also said SafeWork NSW was establishing a new advisory council to hear and consider perspectives from workers, industry, experts, unions and injured workers. She said every worker had the right to return home safely to their loved ones after work.
SafeWork Commissioner Janet Schorer described injuries involving moving plant, vehicles and fixed machinery as preventable hazards seen across NSW and across industries. She said these injuries were an area for action in SafeWork NSW's regulatory priorities this year.
Ms Schorer said: “Having an awareness and assessment of the risks, along with implementation of safe systems of work, is key to reducing the number of incidents related to moving plant.”
Resources for business owners and workers on managing plant and machinery risks are available on the SafeWork NSW website. Workers can raise workplace health and safety concerns anonymously by calling SafeWork on 13 10 50 or using the Speak Up Save Lives website.
