Price Agricultural Pty Ltd has been charged over an incident in May 2022 in which a customer was fatally crushed by a seed bag that fell from a telehandler.

The company faces one charge under section 26(1) of the Occupational Health and Safety Act. The charge concerns an alleged failure to ensure a workplace under its management and control was safe and without risks to health.

It is alleged Price Agricultural failed to eliminate or reduce the risk of serious injury or death to people underneath suspended bulka bags at the workplace.

The customer was using the company’s telehandler to unload seed oats from a bulka bag into a grouper bin on his truck. The bag fell from the telehandler’s tynes and fatally crushed him.

A filing hearing is listed at the Ballarat Magistrates’ Court for 14 May 2024.
