2 Types Constructions Pty Ltd has been convicted and fined $270,000 in the District Court of NSW after a worker fell through an unprotected skylight and suffered serious injuries.
The SafeWork NSW prosecution followed an incident on 19 April 2022 at a building refurbishment project in Kingsgrove, in Sydney’s south. A worker fell about four metres through the skylight onto a concrete floor.
The company pleaded guilty to an offence under section 32 of the Work Health and Safety Act 2011 (NSW), having failed to comply with its duty to workers under section 19(1).
The full judgment is available on the NSW Caselaw website. 2 Types Constructions Pty Ltd can appeal its sentence.
SafeWork Commissioner Janet Schorer said falls from heights were a primary cause of traumatic injuries and fatalities in NSW workplaces, with most occurring in construction.
“SafeWork NSW reminds all businesses of their duty to ensure their workers are protected when working at heights.”
