Ability Works Australia Ltd faces two workplace safety charges following a worker’s fall down a stairwell at its Kew workplace in December 2022. The worker was injured and later died in hospital.

The company faces two charges under section 21(1) of the Occupational Health and Safety Act over an alleged failure to provide and maintain a safe workplace.

WorkSafe alleges Ability Works breached section 21(2)(a) by not providing a safe system of work to prevent workers with mobility or vision impairment from accessing the staircase from the workplace break room.

The organisation is also alleged to have breached section 21(2)(e) by not providing the supervision employees needed to work safely.

The worker who fell during their lunchbreak in December 2022 had vision and hearing impairments.

A filing hearing is listed at the Melbourne Magistrates’ Court for 17 December 2024.
