Boyd Industries Pty Ltd faces charges following the death of a 55-year-old man who was impaled by a telehandler’s fork attachment during construction of a metal-framed roller door.

The man was fatally injured when the attachment impaled him while the roller door was being constructed at the workplace.

Boyd Industries faces three charges under section 23(1) of the Occupational Health and Safety Act. The charges concern an alleged failure to ensure people other than employees were not exposed to risks to their health and safety.

WorkSafe alleges the company failed to reduce, so far as was reasonably practicable, the risk of serious injury or death arising from contact between a person and the telehandler, its load or an attachment.

The company is also alleged to have breached regulation 327(1) of the Occupational Health and Safety Regulations by failing to prepare and use a Safe Work Method Statement (SWMS) for high risk construction work.

A filing hearing is listed at Warrnambool Magistrates’ Court on 20 December 2024.
