HSG Developments Pty Ltd and HSG Asphalt Pty Ltd have each been charged following an incident in which a 34-year-old was run over by a skid steer loader and later died in hospital.
A co-worker was operating the skid steer loader after hours when the 34-year-old was run over.
Each company faces a charge under section 21(1) of the Occupational Health and Safety Act over an alleged failure to provide and maintain a safe workplace so far as reasonably practicable.
WorkSafe alleges the companies breached section 21(2)(a) by failing to provide and maintain a system of work to securely store operating keys for plant, including the skid steer, to prevent access by untrained or unauthorised people.
Both companies also face a charge under section 23(1) of the Act for allegedly failing to ensure people other than employees were not exposed to health and safety risks.
A filing hearing is scheduled at the Melbourne Magistrates' Court on 2 September 2024.
