Anthony Basa, trading as Big Basa Constructions, and Pearl Construction Group Pty Ltd have been charged following a 23-year-old worker’s fatal fall at a construction site.
The worker was installing roof trusses on the development’s first floor when he fell through a stair void that was unprotected, landing on the concrete floor below.
Basa, 29, and Pearl Construction Group each face one charge under section 26(1) of the Occupational Health and Safety Act over an alleged failure to ensure the workplace was safe and without risks to health.
WorkSafe alleges that both failed to control the risk of a fall from height so far as was reasonably practicable.
Basa also faces a charge under regulation 327(1)(a) of the OHS Regulations for allegedly failing to prepare a safe work method statement before carrying out high risk construction work.
Both matters are scheduled for a committal mention at Melbourne Magistrates’ Court on 25 November 2024.
