Flow Smart Vic Pty Ltd faces two workplace safety charges after a worker suffered a serious brain injury while helping to fit fork extensions to a telehandler in October 2023.
The company faces two charges under section 21(1) of the Occupational Health and Safety Act over an alleged failure to provide and maintain a safe workplace.
The alleged breaches concern section 21(2)(a), relating to providing and maintaining a safe system of work, and section 21(2)(e), relating to providing the information, instruction or training employees need to work safely.
WorkSafe alleges Flow Smart Vic failed to eliminate or reduce the risk of workers being struck while telehandler fork extensions were being installed.
The worker was standing on a truck tray and helping guide the extensions onto the telehandler's tynes when he was struck. He fell from the tray and sustained a serious brain injury.
A filing hearing is scheduled at Sale Magistrates' Court on 7 January 2025.
