D'Orsogna Ltd faces four charges under Victoria's Occupational Health and Safety Act following a forklift incident involving a worker at a cured meats warehouse.
The charges fall under section 21(1) of the Occupational Health and Safety Act and concern alleged failures to provide and maintain a safe workplace.
WorkSafe alleges two breaches of section 21(2)(a): failing to maintain a safe system of work separating powered mobile plant from pedestrians, and failing to properly maintain the forklift.
The company also allegedly breached section 21(2)(e) by not providing the instruction and training employees needed to operate a forklift safely.
WorkSafe further alleges D'Orsogna breached regulation 109(1)(d) of the OHS Regulations by failing to reduce, so far as was reasonably practicable, the risk of forklifts colliding with pedestrians or other powered mobile plant.
A committal mention is scheduled at the Melbourne Magistrates' Court for 25 March 2025.
