Winslow Infrastructure Pty Ltd has entered into an enforceable undertaking estimated at $300,000 after traffic management barriers overturned and seriously injured a worker in Carrum Downs.

On Thursday 19 December, the Frankston Magistrates' Court heard the company had entered into the undertaking while facing two charges: failing to provide a safe workplace and failing to ensure plant was installed, erected or commissioned safely and without risks to health. WorkSafe may reinstate the charges if the undertaking is contravened or withdrawn.

The incident occurred in February 2023 while the company was completing the Lanthams Road Upgrade. A total of 23 traffic management barriers, with fencing attached, overturned as the worker walked past. The barriers were being used to mark out pedestrian walkways.

The worker was trapped beneath the barriers and sustained six broken ribs, a broken collarbone, two collapsed lungs and a blood clot in one lung.

An investigation found Winslow Infrastructure had not followed the manufacturer's instructions to fill the barriers with water. WorkSafe alleges it was reasonably practicable for the company to have a safe system of work for setting up and maintaining the barriers.

WorkSafe Executive Director of Health and Safety Sam Jenkin described the incident as a serious failure to follow basic safety procedures. He welcomed the company's progress towards improving safety for its workers, contractors and the wider community.
