Health and Safety Representatives (HSRs) - Roles, Rights and Powers Explained

✍️ BlueSafe Technical Team📅 18 Mar 2026

Quick answer: An HSR is a legally elected worker representative with real WHS powers, including the ability to raise issues formally and issue a PIN. Employers must support the role, not ignore it.

Last reviewed: March 2026 by the BlueSafe Technical Team. Reflects current Australian WHS laws and regulations.

HSRs are one of the strongest consultation mechanisms in WHS law. When the role is used properly, it helps the business surface hazards early and fix them before they become incidents.

What is a Health and Safety Representative?

An HSR represents a work group on health and safety matters. The HSR does not replace management, but the role gives workers a legal pathway to raise issues, inspect the workplace, and push for action when problems are not being solved.

How are HSRs elected?

The election process starts when workers request representation. The employer then has to facilitate the election for the work group. The work group should be defined clearly so the HSR represents people with similar work conditions and safety concerns.

StepWhat happens
RequestWorkers ask for an HSR
Work groupThe business and workers define the group
ElectionWorkers choose their representative
NotificationThe result is recorded and communicated
TrainingThe HSR is entitled to approved training

What powers does an HSR have?

PowerDescriptionWhen it applies
Inspect the workplaceWalk the site and review hazardsWhen needed to represent the work group
Be present at investigationsAttend interviews and incident reviewsWhen the matter affects the group
Access WHS informationReview relevant safety documentsTo represent the work group properly
Consult with the PCBURaise and discuss issuesDuring safety decision making
Issue a PINFormally require a breach to be fixedWhen a duty breach is reasonably believed to exist
Direct cessation of unsafe workIn serious cases, direct unsafe work to stopWhere the law allows and the risk is serious

What is a PIN?

A Provisional Improvement Notice is a formal notice that can push a business to act. It should contain the breach, the legal duty involved, and the steps needed to fix it. If the PCBU thinks the notice is wrong, it can request a review by an inspector, but the notice should be taken seriously until that happens.

What must the PCBU provide?

The PCBU must give the HSR the support needed to perform the role. That includes information, training, time, and access to the workplace. If the business treats the HSR as a nuisance, the consultation system usually gets weaker, not stronger.

How should businesses work with HSRs?

The best approach is routine and respectful. Include the HSR early in hazard discussions, share the facts, and record the agreed action. HSRs can help the business avoid the "we told them" trap by keeping consultation genuine.

How does the HSR role connect to other WHS topics?

HSRs are closely linked to WHS consultation requirements, the right to cease unsafe work, and improvement and prohibition notices. If the business is already managing incidents or notices, the HSR can be part of the fix.

State and territory variations

HSR powers exist in the harmonised WHS jurisdictions, but the practical election process and training pathways can vary slightly.

Frequently asked questions

What is a Health and Safety Representative (HSR)?

An HSR is a worker elected to represent a work group on WHS matters. The role gives workers a legal voice in safety decisions.

How is an HSR elected?

Workers request an election and the PCBU facilitates the process. The work group then elects its representative.

What is a Provisional Improvement Notice (PIN)?

A PIN is a formal notice that an HSR can issue when a WHS breach is believed to exist. It should be treated as a serious legal step.

What must a PCBU provide to an HSR?

The PCBU must provide information, training, access, and reasonable time to do the role. That support is part of the consultation system.
